Unique Identification Authority of India (UIDAI), the authority responsible for the processes of enrolment and authentication of Aadhaar has confirmed that it can be issued only to people who are resident in India.
Section 3.1 of the Aadhaar Act 2016 states that only a resident shall be entitled to obtain an Aadhaar number. Therefore most of the NRIs, OCIs and PIOs may not be eligible for Aadhaar card.
However, OCI and PIO holders, as well as NRIs, can apply for Aadhaar, if they stay in India for more than 182 days or more in 12 months, immediately preceding the application.
Linking Aadhaar, PAN and Bank accounts
The Prevention of Money-laundering (Maintenance of Records) Rules, 2017 and Section 139AA of the Income Tax Act, 1961, it says, also clearly stipulate that the linking of Bank Accounts and PAN is for those persons “who are eligible to enrol for Aadhaar” as per the Act.
